On Monday, April 23, the Lake Superior State University Judiciary Board was brought together to hear the case of LSSU Dance Company v. Standards Board of Presidents’ Council.

In an earlier Standards Board meeting, the Dance Company requested that the Standards Board advise Presidents Counsel on whether or not to admit the Dance Company as an Official Club so they could have meetings under the title of  “LSSU Dance Company” over the summer. However, there were many complications with the paperwork that needed to be submitted, the Standards Board decided, on their last meeting of the year, to table the request. This did not rest well with the Dance Company, as they were hoping to meet over the summer.

Standards Board reported that the necessary paperwork was not present at their meeting, and therefore they could not make a valid decision. The LSSU Dance Company argued that the paperwork had, in fact, been submitted, and therefore they were not at fault. It turned out, that the paperwork had been submitted to Campus Life Director, Michelle Thalacker.  Ms. Thalacker happened to be out of town to a conference for the week, and was not able to process the paperwork in time for the Standards Board Hearing.

The Dance Company maintained that because it was not their fault that the paperwork was not submitted to the Standards Board, and because they needed to meet over the summer to raise funds for the club, that the Standards Board should hold an emergency meeting that night, to decide. Upon review of the Standards Board bylaws, it was found that the Standards Board was only required to make a decision about whether or not to advise a club to Presidents' Council after reviewing its paperwork. Because the LSSU Dance Company did not provide the paperwork, the Standards Board was under no obligation to do so. The Judiciary Board ruled that although it was not required to hold an emergency meeting to decide the fate of the LSSU Dance Company before summer, it was recommended.
